Spain Investment Immigration

Investment immigration is the definition given to a foreign individual that invests a set amount of money into the country they wish to gain a permanent residency permit in. The residency permit will enable them to live and carry out business in that country. It is important to acknowledge that each jurisdiction provides for different requirements to be met in order to qualify for a residency permit through investment immigration.

Why Immigrate to Spain

Spain is an ideal location for business set up as it is situated within Europe, providing the business with a geographical advantage for effective business relations across Europe. Additionally, Spain boasts a strong and stable economic infrastructure. As a member of the EU, Spain offers a range of benefits to its residents including a high standard of living, reasonable housing prices, good standards of health care and education and reasonable living costs.

Investor Visa

The Investor Visa in Spain is a program that allows an individual to gain full residency rights through monetary investment into a project, which is economically beneficial to the state. There are two forms of investment visas:

1) Residence visa for non-lucrative purposes

2) Residence visa for investors or self employed

There are several conditions which apply to an individual seeking permanent residency under the investor program. These conditions include:

- The investor must have a plausible business plan for investing in a new business enterprise in Spain

- Applicants must have a minimum of EUR 100,000 for investment

- Once the investment is processed, the applicant will be the director of the enterprise

- The capital drawn from the new business is accessible to the investor immediately

- Individuals who invest into new business start ups or already established businesses are applicable under this program

- The applicant’s family members can also apply for residency under the main applicant’s visa submission.

- Investment visas are unlimited in validity, provided the investment is maintained and managed in Spain

- The applicant must demonstrate evidence by means of certified documentation with regards to his business plan, value of investment and also the number of job opportunities they intend to create as a result of their investment

Within the investment visa application, the applicant must detail how their investment will benefit Spain’s economy and create jobs in local areas. Obtaining the residency visa will enable the applicant to carry out business in Spain and reside there for over 182 days per calendar year.

Self Employed Investor Program

The self-employed investor program is designed to help self employed entrepreneurs to reside in Spain through investment. The process of application is as follows:

- The applicant must file a work permit visa to the Ministry of Labor

- The ministry of labor will then send the applicant a Solicitud e Permiso be Trabajo which they must file with the Spanish consulate within a maximum of 30 days, otherwise the approval will be rendered void

- The applicant then needs to file a residency visa application with the Spanish consulate accompanied by their passport, two passport photos and relevant administration fee

- The applicant must also file medical records demonstrating their good state of health

Non-Lucrative Investment Program

The investment visa through a non-lucrative purpose program is aimed at high net worth individuals who intend to reside in Spain but live off money earned outside the country. These types of applicants must submit certified proof that they have funds of $75,000 annually by means of: financial statements, federal tax returns, investments and brokerage accounts. The applicant essentially must prove they are financially able to live in Spain comfortably using money from their estate and not income derived from working in Spain.

Documentation required for submission for an Investment Visa Application:

- Copy of passport

- Recent photos (not more than 6 months old)

- Doctors letter certifying applicant has no health concerns

- Original title deeds to any property owned in Spain

- If the applicant wants to include their spouse or children in their visa application they must provide a marriage certificate and relevant birth certifications for their children.
